Contracts Specialists for a commodity MNC

Our client is a renowned commodity MNC. It is now looking to hire 2 hands-on contract specialists (one at officer and one at specialist level) for its Iron Ore business.

 

Key functions

Deals Validation

  • Check and validate the daily trade entries in Aspect system against the physical deal blotters and Trade Recap, thereby providing key point of control.
  • Ensure the accuracy of data in the system through the validation of the daily trade entries, which has a direct impact on the commercial invoices
  • Ensure all deal blotters are appropriately reviewed and signed off and then properly filed and stored in the relevant systems

 

Contract Management

  • Manage both supplier and customer communications and negotiations regarding contracts.
  • Analyse and identify potential operational issues prior execution that arise from the different contractual terms between purchase and sales contracts and propose resolutions to mitigate such operational risks.
  • Draft both purchase and sales contracts independently
  • Submit contracts to suppliers and customers for review.
  • Liaise with suppliers and customers to agree final terms, escalation to legal and / or Ferrous Trading Purchasing Managers and Iron Ore Marketing Sales Managers  
  • Monitor execution of contract and subsequent filing of all contractual documentation in relevant repository.
  • Manage approval process to deliver timely and accurate returns within the governance framework.
  • Identify and escalate any non-standard deals or contracts.

 

Contract Preparation and Execution

  • Interface with the Traders to understand and analyse key contractual terms and conditions
  • Identify and evaluate potential contractual terms mis-matches for purchase and sales contracts and highlight to the Traders for their attention
  • Work with the Traders to understand their strategies in retaining/ optimizing value through such mis-matches and incorporate such contractual terms in the drafting of the physical contract to protect the firm’s interest
  • Act as a gate-keeper to protect/ minimise the potential value loss through the different contractual / commercial terms of the 3rd party purchase and sales contracts
  • Understand and evaluate the different payment terms of the purchase and sales contracts and provide advice on workability of the contracts to manage cash flow and working capital.
  • Compile draft and final contracts on behalf of the Traders, including addendums and variations. This requires understanding the contractual framework and structure, providing first level contracting advice to the Purchasing/Sales Managers and Sales Operations Specialists; tracking and advising on the compliance of the contractual obligations to Group Policies

 

Contract Reporting

  • Provision of regular and ad hoc reporting in relation to Contract status, customer performance status, service delivery and issues associated with Contractor Administration and Preparation.

 

  • Min 3 to 8 years of experience with contract documentation, preferably in Bulk Commodities (key focus)
  • Operational knowledge of Purchase and Sales of Goods Contracts for Bulk Commodities
  • Transactional or operational knowledge of detailed product specifications, delivery terms (such as laycans, demurrage penalties, etc.) or documentation requirements (bills of lading or payment requirements based on documents).
  • Contract preparation, drafting and administration
  • Understanding of Port and Shipping terms, activities and process
  • Systems administration and management
  • Good communication skills written and verbal
  • Highly proactive with a disciplined approach
  • Strong ability to work multiple parties from a variety of backgrounds
  • An ability to work on own initiative and self-motivated
  • Highly organised, strong workflow/coordination/process orientation
  • Excellent planning and organisation skills and the ability to manage competing priorities
  • Good numerical, analytical skills and attention to detail
  • Excellent problem solving skills
